Scope of application / Validity

This www.aral-lubricants.de is an internet offering of Castrol Germany GmbH, Überseeallee 1, 20457 Hamburg (hereinafter: ‘Aral’). The following General Terms of Use apply to access to and use of the content provided on this website. They also apply to the websites of Aral subsidiaries linked to this site. By accessing this website, the user declares his or her agreement to these general terms and conditions of use. Aral is entitled to change the content of these general terms and conditions of use at any time without prior notice. By continuing to use www.aral-lubricants.de, the user declares his or her agreement to the changes.

Use of content

The content provided on the website is freely accessible to everyone, with the exception of specially marked services within the framework of a closed user group (extranet), and may only be used for private purposes. Aral reserves the right to terminate, expand or restrict the content of www.aral-lubricants.de at any time. If the user has registered for special services in the extranet area, the contractual agreements made in this respect shall apply to this service.

Warranty

1. Use of this website is at the user's own risk. Aral does not guarantee that this website and its contents will always be available. In particular, Aral does not guarantee the suitability of the contents for a particular purpose, their correctness and completeness, the absence of viruses or error-free transmission.

2. Aral does not accept any responsibility for other content and services of non-group third parties that are posted or offered via a link. In this respect, Aral merely provides access. If a user concludes legal transactions with third parties, e.g. for the purchase of goods or the provision of services, Aral is not involved in these transactions. Neither rights nor obligations vis-à-vis Aral arise from such transactions.

3. Aral points out that it does not adopt the contents of the microsites, banners and other advertising spaces as its own and does not assume any liability for them, unless the contents originate from Aral.

Disclaimer

Aral shall only be liable for damages, regardless of their cause, in the event of intent or gross negligence on the part of its employees or other agents. This applies accordingly in the event of a breach of pre-contractual or collateral duties. Liability for a simple negligent breach of duty is also excluded, provided that this does not relate to any material contractual duties. Claims for compensation are limited to typical foreseeable losses. Insofar as services of third parties not belonging to the group are used, Aral is not liable for their qualitative or quantitative availability.

Rights to the contents

SAll rights (e.g. copyrights, intellectual property rights or trademark rights) in relation to the content of this website remain with Aral or its licensors. It is strictly forbidden to use, copy, process, disseminate, publish or download information or trademarks from this website, unless this is explicitly permitted in the General Terms and Conditions of Use. Even after registering on the extranet, the user does not acquire any rights or licences to the content, except for the limited right to use the services and the content in accordance with the general terms and conditions of use and/or contractual agreements.

Data protection

Aral is obliged to treat all personal data in accordance with data protection regulations. Aral is authorised to store and process the user's personal data provided in connection with the use of the extranet for the purpose of processing the utilisation process and for statistical purposes. The data will not be passed on to third parties.

Information obligation according to the Packaging Act

Information for end users (in Germany) about the possibility of returning packaging according to § 15, paragraph 1, sentence 5 of the Packaging Act.

According to the German Packaging Act (VerpackG), we are obliged to take back the following packaging (not subject to system participation) free of charge:

  • Transport packaging,
  • sales and outer packaging that typically does not accumulate as waste with private final consumers after use,
  • system-incompatible sales and outer packaging,
  • sales packaging of pollutant-containing goods or
  • reusable packaging

We will take back the aforementioned packaging free of charge, provided it is used, empty packaging of the same type, shape and size that we carry in our range.

The aim is to increase the return rates. Packaging does not belong in the residual waste, but back into the economic cycle. By returning it, environmentally friendly recycling in accordance with the requirements of the VerpackG can be ensured and, in addition, it can be easier to meet the recycling requirements.

Out-of-court dispute resolution

We are legally obliged to inform you, irrespective of our participation in an alternative dispute resolution procedure, that the EU Commission has set up a platform for out-of-court online dispute resolution between consumers and entrepreneurs, which can be accessed via the following link: http://ec.europa.eu/consumers/odr.
Aral Aktiengesellschaft will not participate in dispute resolution proceedings before a consumer arbitration board within the meaning of the Consumer Dispute Resolution Act (VSBG) and is not obliged to do so.

Final provisions

The law of the Federal Republic of Germany shall apply exclusively. The place of performance is Bochum. Bochum is also the exclusive place of jurisdiction for all claims in connection with these provisions.

Should any of the provisions of these General Terms and Conditions of Use be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a provision that comes as close as possible to the meaning and purpose of the invalid provision. The same shall apply if the General Terms and Conditions of Use are incomplete.
